Terms of use.

These terms apply when you use the Rusty app. They are an agreement between you and CIMP Pty Ltd, the Australian company that makes it. Please read the first two sections even if you read nothing else — they are the ones that matter if things get serious.

1 — Read this first

Rusty is not
an emergency service.

This is the most important thing on the page, so it is not at the bottom in small type where terms like this usually live.

If you are in danger, call 000

Rusty cannot contact emergency services, your employer, your family or anyone else on your behalf, and it cannot do so even if you ask it to. Because you use it anonymously, we have no way to identify you, find you, or send help. In an emergency call 000. For crisis support at any hour call Lifeline on 13 11 14. Never wait for the app instead of calling.

It is not health care and not a diagnosis

Rusty is a wellbeing support tool. It is not a medical device, not a health service, not counselling or therapy, and nothing it says is medical, clinical, psychological or legal advice. It does not diagnose, treat or manage any condition. It complements your employer’s employee assistance program and professional care — it does not replace either, and you should not delay seeking professional help because of anything it says.

It is AI, and it will get things wrong

Every companion is artificial intelligence, not a person, and the app tells you so. AI systems make mistakes: they can be confidently incorrect, misread tone, and miss things a person would catch. Our safety layer is designed to notice when a conversation turns serious, and it will not catch everything — no system, human or automated, does. Use your own judgement, and treat anything practical it tells you as a starting point to check rather than a fact to act on.

Do not rely on it being available

The app needs a working connection, and camp networks are what they are. It may be unavailable, slow, interrupted, or switched off by your employer without notice. Do not build a safety plan around it being there.

2 — Using Rusty

Who it’s for,
and how you get in.

Access comes through your employer. We do not sell it to individuals and there is nothing to sign up for.

You must be 16 or over

Rusty is provided to adults through their workplace. It is not directed at children and must not be used by anyone under 16. Because we collect no identity we cannot verify your age, so this one is on you.

Site codes belong to your employer

Your employer issues the site code and can revoke it. Do not share it outside the workforce it was issued to. If your employer’s agreement with us ends, or they withdraw the code, access ends with it — including yours.

Use it for what it is for

Do not use Rusty to break the law, harass or abuse anyone, impersonate another person, or obtain information intended to harm yourself or someone else. Do not attempt to bypass, disable, probe or reverse-engineer the safety layer, extract the underlying models or prompts, scrape or overload the service, or use it to build a competing product. Do not use automated means to access it.

What you type stays yours

You keep everything you write. You grant us only the permission we need to operate the service — to transmit your message to the model that answers it. We do not store your conversations, we cannot read them, and neither we nor any provider in our chain trains models on them.

3 — Our side of it

What we own,
and what we’ll do.

The app and everything in it

Rusty, the companions, the safety layer, the software, the design and the name belong to CIMP Pty Ltd or our licensors. You get a personal, revocable, non-transferable licence to use the app while your employer’s access lasts, and nothing more. Content your employer publishes into the app belongs to them.

Telling us when it goes wrong

If you send us feedback, a bug report or a suggestion, we may act on it and build it without owing you anything for it. Please do not include anything that identifies you unless you want us to have it.

Changes to the service

We improve the app continuously, and we may add, change or remove features. If we withdraw something you rely on, or discontinue the service entirely, we will give your employer reasonable notice so it can be communicated to you.

Privacy

How we handle information is set out in our privacy policy, which forms part of these terms. The short version: no account, no identity, and conversations that live only on your phone.

4 — Liability

What we are,
and are not, liable for.

Written plainly on purpose. A limitation nobody can read protects nobody, and under Australian law an exclusion that overstates itself is void anyway.

Your rights under Australian Consumer Law come first

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those guarantees, and nothing here should be read as trying to. Everything below applies only to the extent the law allows.

Provided as it is

Subject to the paragraph above, Rusty is provided on an “as is” and “as available” basis. We do not warrant that it will be uninterrupted, error-free, or that its safety layer will identify every situation that needs attention. We say that openly elsewhere on this site too, because it is true and a buyer deserves to hear it from us first.

What we are not liable for

To the extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, loss of profits, revenue, data or anticipated savings, however arising. In particular, and subject to the ACL paragraph above, we are not liable for any decision you make, or do not make, in reliance on anything a companion says, nor for the acts or omissions of any third party you are referred to.

Where liability is capped

Where the ACL applies and the goods or services are not of a kind ordinarily acquired for personal use, our liability for a failure to comply with a consumer guarantee is limited, at our option, to resupplying the services or paying the cost of having them resupplied. Otherwise, and to the extent permitted by law, our total aggregate liability to you is limited to AUD $100 — you pay us nothing for this app, and your employer’s separate agreement with us governs their position.

Nothing here limits what cannot be limited

No part of these terms limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or anything else that cannot be limited under Australian law.

5 — The rest

Endings, changes
and disputes.

Stopping

You can stop at any time by deleting the app, which also destroys the conversations stored on your phone. We may suspend or end your access if you breach these terms in a way that harms other users or the service, or if your employer’s access ends. Where it is reasonable to do so, we will say why.

Changes to these terms

We may update these terms as the product changes or the law does. If a change is material we will bring it to your attention in the app before it takes effect, and it will apply only from that point — never retrospectively. If you do not accept a change, stop using the app.

If something goes wrong between us

Please write to us first at support@askrusty.com.au. Most things are fixable by a person reading an email, and we would rather do that than anything else. Nothing in this paragraph stops you going to a court, tribunal or regulator whenever you want to.

Which law applies

These terms are governed by the laws of Western Australia and the Commonwealth of Australia. You and we submit to the non-exclusive jurisdiction of the courts of Western Australia. If any part of these terms is unenforceable, it is severed and the rest continues to apply.

Your employer’s agreement is separate

These terms cover your use of the app. The commercial agreement between CIMP Pty Ltd and your employer — fees, service levels, reporting and everything else — is a separate contract that you are not a party to, and it does not change anything here.
